Terms of Use

These Terms of Use (“Terms”) govern your access to and use of the Clerked platform, website, and related services (together, the “Services”). By accessing or using Clerked, you confirm that you have read, understood, and agree to be bound by these Terms.

1. About Clerked

Clerked (“we”, “us”, “our”) is a UK-based software platform designed to help solicitors identify and contact barristers by providing visibility of availability, court attendance, and professional information.

Clerked is not a law firm, legal adviser, barristers’ chambers, or agent for any legal professional.

2. Eligibility

To register for and use Clerked, you must:

1. Be at least 18 years old

2. Be a legal professional or authorised representative of a legal organisation

3. Register using accurate and complete information

In addition:

2.1 Barristers must confirm at the point of registration that they are a current, practising member regulated by the Bar Standards Board (BSB). Clerked may request evidence of BSB membership and may suspend or terminate access where this cannot be confirmed.

2.2 Solicitors must confirm at the point of registration that they hold a current practising certificate issued by the Solicitors Regulation Authority (SRA). Clerked may request evidence of SRA certification and may suspend or terminate access where this cannot be confirmed.

2.3 Chambers registrations must be made by, or on behalf of, a designated Primary Clerk who is duly authorised to act on the Chambers’ behalf and to accept these Terms.

We reserve the right to suspend or terminate accounts that provide false, misleading, or unauthorised information.

3. User Roles

Clerked supports the following user types:

5. Barristers (Chambers-affiliated or Solo)

6. Clerks (Primary or Standard)

7. Chambers (non-user organisational entity)

Each role has access only to the features relevant to its function. The following definitions apply:

Role Definition
Primary ClerkThe individual appointed by a Chambers to act as the authorised account administrator and billing contact for that Chambers’ subscription. The Primary Clerk has full administrative access including allocation and management of Seats and management of other Clerks’ access.
SeatA licensed position allocated to an individual Barrister within a Chambers subscription, entitling that Barrister to active access to the Platform under the Chambers account.
Standard ClerkA Clerk operating within a Chambers account with standard access permissions as configured by the Primary Clerk.

4. Account Registration & Security

You are responsible for maintaining the confidentiality of your login credentials.

8. You must notify us immediately of any unauthorised access

9. We may suspend access where we reasonably suspect misuse or security risk

10. Clerked is not liable for loss arising from compromised credentials where reasonable security measures were in place

5. Use of the Platform

You agree to use Clerked:

11. Only for lawful, professional purposes

12. In accordance with these Terms and all applicable laws

13. Without attempting to access data you are not authorised to view

You must not:

14. Scrape, harvest, or extract data from the platform for any purpose outside normal platform use

15. Circumvent access controls or security measures

16. Misrepresent your identity or professional status, including regulatory standing

17. Upload malicious code or interfere with platform operation

18. Use barrister availability or profile data for any purpose other than the genuine identification and instruction of legal professionals through the platform

6. Availability & ClerkedLive

Clerked provides visibility of barrister availability based on:

19. Manual check-ins (ClerkedLive)

20. Calendar availability data (where authorised)

Availability is indicative only. Clerked does not guarantee:

21. Accuracy of diary data

22. That a barrister will accept an instruction

23. That availability will not change

Final instruction, fees, and engagement remain strictly between solicitors, barristers, clerks, and chambers.

7. Calendar Synchronisation (Barristers)

Barristers may optionally connect a supported third-party calendar (such as Microsoft Outlook or Google Calendar). By doing so, you:

24. Grant Clerked permission to access limited calendar availability data

25. Confirm you have authority to grant such access

26. May withdraw consent at any time via your account settings

Clerked does not assume responsibility for errors, omissions, or third-party calendar data inaccuracies.

On termination or cancellation of your Clerked account, any connected calendar authorisation will be automatically revoked and no calendar availability data will be retained beyond the 30-day data retention period set out in section 10.

8. Email Clerk Functionality

The “Email Clerk” feature:

27. Pre-populates an email in the user’s own email client

28. Does not send messages on your behalf

29. Does not store message content

Contact information used to pre-populate emails (such as clerk email addresses) is sourced from professional profile data held on the platform. This data is not retained or further processed by Clerked beyond the point at which the email is pre-populated.

9. Subscriptions & Payments

9.1 Paid Accounts

Certain users (Barristers and Chambers) are required to pay subscription fees. Payments:

33. Are processed via Stripe

34. Are billed monthly unless otherwise stated

35. Are non-refundable except where required by law

9.2 Seat Allocation (Chambers)

Chambers may purchase Seats for Barristers. The following terms apply:

36. Charges begin when a Seat is allocated, regardless of whether the Barrister completes onboarding

37. Seats that are de-allocated mid-billing cycle are not eligible for pro-rata refunds

38. Charges will cease at the next billing renewal date following de-allocation

9.3 Free Trials

Where Clerked offers a free trial period, the following terms apply:

39. Payment details are required at the point of registration for the free trial

40. At the end of the free trial period, your subscription will automatically convert to a paid subscription unless you cancel before the expiry of the free trial

41. You are responsible for cancelling your account before the end of the trial period if you do not wish to be charged

42. If a free trial account is not converted to a paid subscription, any personal data will be securely purged within 30 days of trial expiry in accordance with UK GDPR and our Privacy Policy

We may suspend or terminate access:

You may request cancellation at any time by contacting support@clerked.co.uk.

Following termination or cancellation, Clerked will retain your personal data for a period of up to 30 days, after which it will be securely deleted in accordance with our Privacy Policy and applicable data protection legislation, including UK GDPR. You may request an export of your data prior to deletion by contacting support@clerked.co.uk.

11. Intellectual Property

All intellectual property in the Clerked platform, including:

49. Branding

50. Content (excluding user-provided content)

remains the property of Clerked or its licensors. You are granted a limited, non-exclusive, non-transferable licence to use the platform for its intended purposes.

12. Disclaimers

Clerked is provided on an “as is” and “as available” basis. We do not warrant that:

51. The platform will be uninterrupted or error-free

52. Data will always be accurate or complete

53. The service will meet all professional or commercial needs

13. Limitation of Liability

To the maximum extent permitted by law:

54. Clerked is not liable for indirect, consequential, or economic loss

55. Clerked is not liable for loss of profits, reputation, or opportunity

56. Our total liability is limited to the fees paid in the preceding 12 months

Nothing in these Terms limits liability for:

57. Death or personal injury

58. Fraud or fraudulent misrepresentation

59. Any liability that cannot be excluded by law

14. Indemnity

You agree to indemnify Clerked against claims arising from:

60. Your misuse of the platform

61. Breach of these Terms

62. Unauthorised use of third-party data or systems

15. Privacy & Data Protection

Use of Clerked is subject to our Privacy Policy, which forms part of these Terms.

Clerked does not use cookies or tracking technologies to collect personally identifiable information (PII). Platform navigation activity — such as page views and feature interactions — is tracked in an anonymised or pseudonymised form solely for the purposes of in-product analytics and platform improvement. This data is not used to identify individual users and is not shared with third parties.

16. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via the website or platform. Continued use constitutes acceptance of the updated Terms.

17. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
